Chester District Local Plan Saved Policies
The Chester District Local Plan was adopted 12th May 2006. Under the Planning and Compulsory Purchase Act 2004 and the policies within the Plan were saved for a period of 3 years from the date of adoption. For Chester, this meant that policies in the Chester District Local Plan were saved until May 2009. To ensure that these policies continued to be valid in the determination of planning applications after May 2009, the Council had to secure agreement from the Secretary of State.
To do this the Council had to submit a list of policies they wish to save to Government Office/Secretary of State 6 months before the expiration of the 3 year period, together with a justification.
A review of all Local Plan policies against the Government’s guidance was undertaken and it concluded that all the policies are necessary and should be retained. Failure to do so would create a policy vacuum in Chester District and any planning decisions would have to be based purely on national and regional guidance.
Following agreement from Council, a formal request to extend the saving of the Local Plan policies was submitted to the Secretary of State. Government Office accepted that all except policy HO 1 setting out the scale of housing provision could be retained. Therefore this policy lapsed on 12 May 2009 but all other Chester District Local Plan policies have been retained.
Policies will be reviewed and gradually replaced by policies in the Local Development Framework for Cheshire West and Chester, however it is likely to be some time before replacement policies will be adopted.
